1. Pembentukan

2. Kedudukan

Badan Pertimbangan Daerah adalah suatu forum yang berkedudukan sebagai wadah yang memberikan pertimbangan kepada Kepala Daerah Tingkat I. 

3. Tugas Pokok

Badan Pertimbangan Daerah mempunyai tugas pokok memberikan pertimbangan-pertimbangan kepada kepala daerah baik diminta maupun tidak.

4. Fungsinya Adalah

a) Memantau pelaksanaan penyelenggaraan pemerintah, pelaksanaan pembangunan dan pembinaan kemasyarakatan

b) Memberikan pertimbangan mengenai penyelenggaraan pemerintah, pelaksanaan pembangunan dan pembinaan kemasyarakatan.

5. Susunan Keanggotaan 

Badan Pertimbangan Daerah sebanyak-banyaknya lima (5) orang terdiri dari :

a) Ketua DPRD sebai Ketua merangkap anggota.

b) Wakil - wakil Ketua DPR sebagai anggota. 

c) Unsur - unsur Fraksi yang tidak terwakili dalam Pimpinan DPRD sebagai anggota.

d) Sekertaris DPRD karena jabatannya adalah sekertaris bukan merangkap anggota.

6. Pengangkatan dan Pemberhentian

Ketua, Anggota dan Sekertaris Badan Pertimbangan Daerah diangkat dan diberhentikan oleh :

a) Mentri Dalam Negri bagi Badan Pertimbangan Daerah Tingkat I atas usul Gubernur Kepala Daerah Tingkat I

b) Gubernur Kepala Daerah Tingkat I bagi Badan Pertimbangan Daerah Tingkat II atas Usul Bupati/Wali Kota Madya Kepala Daerah Tingkat II

7. Tata Kerja

a) Badan Pertimbangan Daerah menyelenggarakan rapat sekurang-kurangnya 1 kali dalam 3 bulan dan menyampaikan hasilnya kepada :

    1. Gubernur KDH Tingkat I dengan tembusan kepada Menteri Dalam Negri, bagi Badan Pertimbangan Daerah Tingkat I.

    2. Bupati/Wali Kota Madya KDH Tingkat 2 dengan tembusan kepada Menteri Dalam Negri dan Gubernur KDH Tingkat I bagi Badan Pertimbangan Daerah Tingkat II

b) Sekertariat DPRD berfungsi sebagai Sekertarian Badan Pertimbangan Daerah.

Asas-Asas Penyelenggaraan Pemerintahan Daerah

Sesuai dengan jiwa Pasal 18 UUD 1945 dan berdasarkan Undang-undang No. 5 Tahun 1974, Sistem Penyelenggaraan Pemerintahan di Daerah didasarkan pada asas desentralisasi, asas dekonsentrasi dan asa tugas pembantuan.

A. Asas Desentralisasi

Desentralisasi adalah penyerahan urusan pemerintahan dari pemerintah atau Daerah tingkat atasnya kepada Daerah menjadi urusan rumah tangganya. Urusan-urusan pemerintahan yang telah diserahkan kepada Daerah dalam rangka pelaksanaan asas desentralisasi pada dasarnya menjadi wewenang dan tanggung jaab Daerah sepenuhnya. Dalam hal ini prakarsa sepenuhnya diserahkan kepada Daerah, baik yang menyangkut penentuan kebijaksanaan, perencanaan, pelaksanaan maupun yang menyangkut segi-segi pembiayaannya. Demikian pula perangkat pelaksanaanya adalah perangkat Daerah itu sendiri yaitu terutama Dinas-dinas Daerah dan pegawai-pegawai Daerah.

B. Asas Dekonsentrasi

Dekonsentrasi adalah pelimpahan wewenang dari Pemerintah atau kepada Wilayah atau Kepala Instansi Vertikal tingkat atasnya kepada pejabat-pejabatnya di Daerah.

Oleh karena tidak semua urusan pemerintahan dapat diserahkan kepada Daerah menurut asas desentralisasi, maka penyelenggaraan berbagai urusan pemerintahan di daerah dilaksanakan oleh perangkat Pemerintah Pusat di Daerahberdasarkan asas dekonsentrasi. Urusan-urusan yang dilimpahkan oleh Pemerintah Pusat kepada pejabat-pejabatnya di Daerah menurut asas dekonsentrasi ini tetap menjadi tanggung jawab Pemerintah Pusat baik mengenai perencanaan, pelaksanaan, maupun pembiayaannya. Unsur pelaksanaanya adalah terutama instansi-instansi vertikal yang dikoordinasikan oleh kepala wilayah dalam kedudukannya selaku perangkat pemerintah pusat.

Kebijaksanaan pelaksanaan urusan dekonsentrasi sepenuhnya ditentukan oleh Pemerintah Pusat.

C. Asas Tugas Pembantuan 

Tugas Pembantuan adalah tugas untuk turut serta dalam melaksanakan urusan pemerintahan yang ditugaskan kepada Pemerintah Daerah oleh Pemerintah Pusat atau Pemerintah Daerah tingkat atasnya dengan kewajiban mempertanggungjawabkan kepada yang menugaskannya.

Tidak semua urusan pemerintahan dapat diserahkan kepada daerah menjadi urusan rumah tangganya, sehingga beberapa urusan pemerintahan massih tetap merupakan urusan Pemerintah Pusat. Akan tetapi adalah berat sekali bagi Pemerintah Pusat untuk menyelenggarakan seluruh urusan pemerintahan di Daerah yang masih mejadi  wewenang dan tanggung jawabnya itu atas dasar dekonsentrasi, mengingat terbatasnya kemampuan perangkat Pemerintah Pusat di Daerah. Di samping itu ditinjau dari segi daya guna dan hasil guna adalah kurang dapat dipertanggungjawabkan apabila semua urusan pemerintah Pusat di Daerah harus dilaksanakan sendiri oleh perangkatnya di Daerah, karena hal itu akan memerlukan tenaga dan biaya yang sangat besar jumlahnya Selain itu mengingat sifatnya, berbagai urusan sulit untuk dapat dilaksanakan dengan baik tanpa ikut sertanya Pemerintah Daerah yang bersangkutan.

Agar tugas pokok aparatur pemerintah dapat terlaksana dengan baik, maka dalam penyusunan kelembagaan perlu didasrkan pada asas-asas pengorganisasian yang tepat, antara lain sebagai berikut :

1. Asas Kejelasan Tujuan

Organisasi pemerintah diciptakan untuk mencapai tujan yang telah ditetapkan untuk suatu jangka waktu tertentu. Oleh sebab itu didalam penyusunan pengorganisasian aparatur pemerintah harus jelas kaitannya dengan tujuan yang ingin dicapai.

2. Asas Pembagian Tugas

Dalam pengorganisasian aparatur pemerintah tugas umum pemerintah dan pembangunan perlu dibagi habis kedalam tugas-tugas Departemen, lembaga pemerintahan Non Departemen dan aparatur pemerintah lainnya sehingga dapat dijamin selalu tanggung jawabdalam menyelenggarakan pemerintahan dan pembangunan. Namun demikian hal ini tidak berarti bahwa suatu instansi pemerintah dapat melaksanakan sendiri. Tugas pemerintahan dan pembangunan yang menjadi tanggung jawabnya tanpa adanya kerja sama dengan instansi yang terkait. Sesuai dengan asa ini maka perlu adanya perumusan tugas yang jelas sehingga dapat dicegah duplikasi, benturan dan kekaburan. Sejalan dengan pengorganisasian pemerintah diatas, asas ini pun harus diterapkan dalam pengorganisasian dalam setiap instansi pemerintah.

3. Asas Fungsionalisasi

Sesuai asas fungsionalisasi, dalam pelaksanaan tugas umum pemerintah dan pembangunan harus ada satu instansi yang secara fungsional paling bertanggung jawab. Dengan kata lain asas ini menentukan instansi atau satuan kerja mana yang paling fungsional bertanggung jawab atas suatu tugas umum pemerintah dan pembangunan. Pada gilirannya Asas ini akan menentukan mekanisme koordinasi dalam arti bahwainstansi atau satuan kerja yang fungsional paling bertanggung jawab tersebut untuk memprakarsainya.

4. Asas Pengmbangan jabatan fungsional

Penyusunana organisasi aparatur pemerintah hendaknya tidak hanya berorientasi pada pengembangan jabatan struktural saja, melainkan juga pada jabatan fungsional..

5. Asas Koordinasi

Asas ini menekankan agar dalam penyusunan kelembagaan instansi pemerintah memungkinkan terwujudnya koordinasi yang mantap dalam pelaksanaan tugas-tugas pemerintah dan pembangunan.

6. Asas Kesinambungan

Asas kesinambungan mengharuskan pelembagaan dalam pelaksanaan dalam arti tugas-tugas umum pemerintah dan pembangunan harus terus berjalan terus menerus sesuai dengan kebijaksanaan dan program yang telah ditetapkan tanpa tergantung diri pejabat/pegawai tertentu.

7. Asas Kesederhanaan 

Sebagai alat untuk mencapai tujuan, maka organisasi harus secara mudah menggambarkan dengan jelas siapa/unit apa untuk mengerjakan apa, bekerja dengan siapa dan dengan cara bagaimana.

8. Asas Keluwesan

Asas keluwesan menghendaki agarorganisasi selalu mengikuti dan menyesuaikan diri dengan perkembangan dan perubahan keadaan sehingga dapat dihindarkan kekakuan dalam pelaksanaan tugasnya.

9. Asas Akordion

Dalam pengembangan organisasi sebagai dimaksud dalam asas keluwesan, asas akordion menentukan bahwa organisasi dapat berkembang atau menciut sesuai dengan tuntutan tugas dan beban kerjanya.

10. Asas Pendelegasian Wewenang

Asas ini menentukan tugas tugas apa yang perlu didelegasikan dan tugas tugas apa yang masih harus di pegang pimpinan sebagai konsekuwensi dari asas pelimpahan wewenang tersebut maka setiap unit yang menerima pelimpahan harus mampu melaksanaan wewenang dan tugas-tugas yang dilimpahkan.

11. Asas Rentang Kendali  

Dalam asas rentang kembali ini dimaksudkan agar dalam menentukan jumlah satuan organisasi atau orang yang dibawahi oleh seorang pejabat pimpinan, diperhitungkan secara rasional mengingat terbatasnya kemampuan seorang pimpinan/atasan dalam mengadakan pengendalian terhadap bawahannya

12. Asas Jalur dan Staf

Ada beberapa cara yang digunakan untuk pengorganisasian pemerintah. Namun demikian agar terdapat kejelasan antara tugas pokok dan penunjang, maka dalam pengorganisasian kelembagaan aparatur pemerintah digunakan asas jalur dan staf. Asas jalur dan staf adalah asas yang menentukan bahwa dalam penyusunan organisasi perlu dibedakan antara satuan-satuan organisasi yang melaksanakan tugas pokok instansi dengan satuan-satuan organisasi yang melaksanakan tugas-tugas penunjang.
